Terms of Service

1. Acceptance of Terms

By engaging Hostiva's services, you agree to these Terms of Service. These terms govern all services provided by Hostiva, including website development, software development, hosting, maintenance, and digital marketing.

2. Services

Hostiva provides digital services as described in our service agreements and proposals. All project scopes, timelines, and deliverables will be agreed upon in writing before work begins. Any additional work outside the agreed scope may incur additional charges.

3. Payment Terms

• Projects typically require 50% upfront payment before work begins
• The remaining balance is due upon project completion before final delivery
• Monthly services (hosting, maintenance, marketing) are billed at the start of each period
• Overdue payments may result in service suspension

4. Intellectual Property

Upon full payment, clients receive full ownership of the custom website or software developed for them. Hostiva retains the right to showcase completed work in our portfolio unless otherwise agreed in writing.

Third-party assets (fonts, images, plugins) remain subject to their respective licenses. Clients are responsible for ensuring they have proper licenses for any content they provide.

5. Client Responsibilities

Clients agree to:

• Provide accurate information and required content in a timely manner
• Provide prompt feedback within 5 business days of receiving deliverables
• Ensure all content provided does not infringe on third-party rights
• Make payments as agreed

6. Project Timelines

Timelines provided are estimates. Delays may occur due to client feedback delays, scope changes, or unforeseen technical issues. We will communicate any timeline changes promptly.

7. Warranties & Limitations

Hostiva warrants that services will be performed professionally and with reasonable care. We do not guarantee specific business results from websites, marketing, or software. Our liability is limited to the amount paid for the specific service in question.

8. Termination

Either party may terminate a project with written notice. In case of termination, payment is due for all work completed up to the termination date. Prepaid hosting or maintenance fees are non-refundable (see Refund Policy).

9. Governing Law

These Terms are governed by the laws of Nepal. Any disputes will be resolved through mutual negotiation first, and if necessary, through applicable legal channels in Biratnagar, Nepal.
